What Does the Law State?
The Fair Debt Collection Practices Act was signed into law in 1977 by President Jimmy Carter. It gives debtors protection against unethical debt collection practices. Under the law, debt collectors are not allowed to use abusive, unfair, or deceptive practices to collect debts. This law does not apply to business debt, nor does it cover collection by the original creditor or business you owe money to. It does apply to consumer debt collectors, such as collections agencies, debt buyers, and lawyers.
Unfair Debt Collection Defense

- Time and place. Debt collectors may not contact you before 8 a.m. or after 9 p.m. Debt collectors may not call you at work if you inform them you’re not allowed to receive personal phone calls. If they call and you tell them it’s an inconvenient time to talk to them, they must hang up.
- Social media and other electronic communication. A debt collector can not post publicly about a debt you supposedly owe them on social media. They may contact you privately on social media — unless you tell them they can’t.
- Harassment. Debt collectors may not harass you or anyone else over the phone or through any other means of contact. Harassment includes the following:
- Repetitious phone calls, emails, text messages, or social media contacts.
- Obscene or profane language.
- Threatening violence or harm.
- Publishing lists of people who refuse to pay their debts (this does not include reporting information to a credit reporting agency).
- Calling you without telling you their name.
- Representation by an attorney. If a debt collector knows you have an attorney for debt collection lawsuits representing you, generally they must contact the attorney instead of you.
