Illegal Tactics Debt Collectors Use

Fair Credit Reporting Act
Credit discrepancies are another type of work we litigate. Lenders and credit reporting agencies must abide by the Fair Credit Reporting Act. Here are two examples we frequently see:
- In this scenario a consumer’s credit rating is being incorrectly reported by any or all the three major credit reporting agencies: Equifax, TransUnion, or Experian. These three agencies use outdated software based on 1980s and 1990s architecture. Thus, it’s all too common for people with the same name to have their files intermingled, causing all types of inaccuracies and problems. It is usually very difficult to get the credit agency to fix the mistake. The agency will try and falsely deflect the blame from themselves by claiming someone is trying to steal your identity — until we bring a lawsuit against them and win a judgment and damages for our client.
- Discrepancies with a consumer debt. Often, a consumer will have paid a debt or paid it down, but it is still showing on their record as unpaid or showing an inaccurate amount owed. If the lender won’t correct the amount owed, we will file a lawsuit against unfair credit reporting, forcing them to fix the error.
Indiana Debt Laws
In Indiana, creditors have six years to get a judgment on you for nonpayment on a loan. Once they have a judgment, they have 20 years to collect. Don’t despair. We can often negotiate with the collectors, banks, and lenders to find a payment plan that works for you.
